Local apparel retailer wins ‘Forever 21’ brand IPR

A Philippines court has ruled in favour a local clothing company in its legal battle with an American company which is in to selling of accessories like handbags, wallets, clothing and jewelry over the ‘Forever 21’ brand.

The 28 page judgment upheld the ruling of the Office of Intellectual Property Rights which had said that the American company had failed to produce evidence of promoting its own trade mark in Philippines before the local businessman.

The local businessman, Romeo Chong runs a company by the name of ‘Forever 21 Fashion Apparel Inc’ had applied for a trade mark on March 28, 2003 or nine months before the American company applied for the same in Philippines.
